Last Revised March 1, 2004 Drake Analytics, Inc. ("Company"), the owner of NRS-Online.com, and the subscriber to the NRS-Online.com services ("Subscriber") agree to the following terms and conditions. Term and Renewal: The term of the subscription service is five years. Renewals may be made in advance at the current subscription rate, which may differ from the original subscription rate. The Subscriber authorizes the Company to maintain registered items and records pertaining to registered items after the expiration of the term of subscription. Safekeeping: Although the Company will exercise its best judgment in ensuring the protection of stored media and data, the Company accepts no responsibility for loss, corruption, damage or destruction of registered media and data. In the unlikely event that media is destroyed, damaged, corrupted, or lost, Subscriber agrees that the Company and its employees, managers, shareholders and directors cannot be held liable for damages due to media and/or data that is lost, destroyed, corrupted or damaged. The Subscriber agrees that no compensation will be provided for media or data that has been lost, corrupted, damaged or destroyed, whether by accident, negligence, error, act of God or other incident. Withdrawal, Copy Destruction and Authentication of Registered Items: Requests for copies, withdrawal, authentication or destruction of registered material can only be made by the original registrant. The Company reserves the right to confirm the request by having the Subscriber provide the request in the form of a notarized letter or e-mail from the account listed on the registration form of the corresponding item. Additional confirmation methods may also be employed by the Company. The Company reserves the right to refuse any request for withdrawal, copy, authentication or destruction if it believes it cannot confirm the legitimacy of a request. All costs incurred in satisfying an authentication request shall be the responsibility of the Subscriber. If a registrant is deceased, proof of death in the form of a certified death certificate and written consent by the representative of the Subscriber's estate is required. Additional Service Fees: The Company may offer fee-based services. All fees are non-refundable. Details of these services will be, if they exist, posted on the nrs-online.com and/or nrs2.com web sites and are subject to change. The Company reserves the right to add additional services or withdraw services. If a Subscriber is using a service that is discontinued, the Company is not obligated to provide a refund unless it is the base registration service that is discontinued - at which time the company must refund the pro-rated amount of the unused subscription. Use of the Service: The Subscriber agrees to not use the registration or other services for illegal activities or in support of illegal activities. Illegal activities are those activities that break the laws of the United States of America and/or Washington State Law. The Company reserves the right to refuse to provide the service to any Subscriber at its discretion at any time during the subscription term. The Company also reserves the right to deny a subscription application. If a subscription application is denied a 100% refund is provided to the Subscriber. If the service is refused or terminated the Company agrees to provide a pro-rated refund. If the service is refused or terminated, the Subscriber may request collection of all registered items at cost to themselves. Otherwise, all registered items and records of such will be destroyed within 90-days of service termination. The Subscriber agrees to complete a Registration Form, whether online or on paper, for each item that is sent to be registered. Items received without registration forms will not be registered nor subject to authentication. Items not returned (which Subscriber agrees is at at cost to themselves), will be destroyed within 30-days of receipt. Subscriber agrees to not register items on behalf of others ("beneficiary") except in cases where the Subscriber serves as legal counsel for the beneficiary, holds a DPOA for the beneficiary, or is a legal guardian of the beneficiary. Subscriber agrees that they will not resell registration services without the permission of the Company and that their account will only be used to register and store items of their own production. Subscriber agrees that they will not attempt to register items that they do not own or have a legal right to. Service Refunds: If the Subscriber purchased a subscription directly from the Company and they request that their account be terminated and a refund be issued then the Subscriber is entitled to a partial refund of $24. Subscriptions made through a reseller are not entitled to a refund or partial refund from the Company. The Subscriber should contact the reseller for the terms of the sale. Corporate Subscriptions: The duration of these subscriptions is ONE YEAR. The price for these subscriptions is $495 per year. Refunds of $295 are available if a corporate subscription is canceled within 30-days of the subscription date. Ownership: The entity that paid for the subscription is considered the Subscriber and is the owner of all registered items, if those items were acquired in accordance with the law. If the identity of the Subscriber is in question, Credit Reporting and/or Banking information will be used to confirm the identity of the individual whose assets were used to pay for the subscription. Subscriber agrees to provide such information upon request or forfeit their subscription and any rights granted to them due to their subscription.
